Terms of Service

Introduction

These Terms of Use (the “Terms”) govern your access to and use of https://tradingwithdavid.com (the “Website”), a personal website operated by David Carli, Italy, under the name Trading with David (“we”, “us” and “our”).

The Website provides articles, educational resources, commentary and information relating to financial markets, trading, technical analysis and other financial topics. It also promotes books written by David Carli and may include advertising banners, affiliate links and references to third-party services.

The Website does not sell products or services directly and does not process payments from visitors. Access to its publicly available content is free of charge.

By using the Website, you agree to comply with these Terms. We may update them when necessary to reflect changes to the Website, applicable laws or our practices. The latest version will be published on this page with its date of revision.

Privacy & Cookie Policy

Our Privacy & Cookie Policy explains how personal data is collected and processed, how cookies and similar technologies are used, and what rights visitors have under applicable data protection legislation.

Where consent is required for optional cookies or other processing activities, it is requested separately through the appropriate consent mechanisms. Acceptance of these Terms does not constitute consent to the processing of personal data for purposes that require separate consent.

Educational Purpose and Trading Risks

All information published on Trading with David, including articles, market commentary, charts, technical analysis, examples, educational materials and other content, is provided exclusively for educational and general informational purposes.

Nothing published on the Website constitutes personalised investment advice, financial advice, a recommendation to buy or sell financial instruments, or an invitation to undertake any particular investment or trading activity.

Trading and investing in financial markets involve risks, including the possible loss of some or all of the capital invested. Certain financial instruments, particularly leveraged products and derivatives, may involve substantial risks and may not be suitable for all investors.

Any trading strategies, techniques, market observations or examples discussed on the Website are intended to illustrate general concepts. They do not guarantee particular results and should not be interpreted as suitable for any individual visitor’s financial circumstances, experience, investment objectives or tolerance for risk.

Past performance, whether actual, simulated or hypothetical, is not a reliable indicator of future results. Examples and historical market data cannot predict future market behaviour with certainty.

Visitors remain responsible for their own financial decisions. Before making investment or trading decisions, they should independently evaluate the relevant risks and, where appropriate, seek advice from a suitably qualified and authorised professional.

Although we aim to provide accurate and useful educational information, financial markets, regulations, economic circumstances and trading conditions may change. Content published on the Website may therefore become outdated and should not be relied upon as a source of real-time market information.

Third-Party Websites and Services

The Website may contain links to external websites, platforms, applications and services, including financial information providers, brokers, social media platforms, educational resources and online retailers.

These external websites and services are operated independently. We do not control their content, availability, security, commercial terms or privacy practices. A link to an external website does not necessarily imply endorsement of all the information, products or services it provides.

When you access a third-party website, you are subject to its own terms of use, privacy policy and other applicable conditions. We recommend reviewing those documents before using its services or providing personal information.

We are not responsible for the acts or omissions of independent third-party operators. This provision does not exclude any responsibility that cannot lawfully be excluded.

Books and Publications

The Website may present, describe and promote books and other publications written by David Carli, including works relating to financial markets, trading and other subjects.

These publications may be available for purchase through Amazon or other independent retailers. The Website does not sell the books directly, collect payment information or process orders.

Any purchase made through an external retailer is governed by that retailer’s terms, prices, payment conditions, delivery arrangements and applicable consumer rights.

Questions relating to orders, payments, refunds, delivery or other aspects of a purchase should be addressed to the retailer concerned, without prejudice to any rights that applicable law may provide against other responsible parties.

The opinions, explanations, strategies and examples contained in the publications are subject to the same general educational-purpose and financial-risk considerations described in these Terms.

Advertising and Affiliate Links

The Website may display advertising banners, promotional images and links to third-party products or services. Such content may include commercial arrangements or affiliate relationships.

In exchange for displaying SpreadCharts promotional banners, the Website owner receives a complimentary subscription to the SpreadCharts service.

Links to Mexem are affiliate links. Any commissions generated through these links are donated to charity.

These arrangements do not mean that the Website provides investment advice on behalf of the companies concerned or guarantees the quality, suitability, performance or safety of their products and services.

Visitors should independently evaluate any third-party product or service before using it, particularly where financial risks are involved.

External advertisements and affiliate links may direct visitors to websites governed by separate terms and privacy policies.

Prohibited Uses and Intellectual Property

Unless otherwise indicated, the original articles, written materials, graphics, logos, images, illustrations, layouts and other original content published on the Website are owned by David Carli or used with the permission of their respective rights holders. They are protected by applicable copyright and intellectual property laws.

Visitors may access and read the Website for personal, educational and other lawful purposes. Nothing in these Terms restricts uses expressly permitted by applicable law, including lawful quotation and other applicable copyright exceptions.

Except where permitted by law or expressly authorised by the relevant rights holder, visitors may not reproduce substantial parts of the Website, republish original articles in full, distribute protected materials commercially, remove copyright notices or present the Website’s content as their own.

Any authorised reproduction or quotation must respect the applicable conditions of use, including attribution where required.

Visitors must not:

  • use the Website for unlawful, fraudulent or abusive purposes;
  • attempt to gain unauthorised access to the Website, its administration systems or related infrastructure;
  • introduce malicious software or interfere with the security, integrity or availability of the Website;
  • submit spam, unsolicited promotional messages or other abusive communications through contact forms, comments or other interactive features;
  • use automated tools in a manner that disrupts the Website, compromises its security or infringes the rights of others;
  • infringe intellectual property rights or other rights protected by applicable law.

These restrictions are intended to protect the Website, its content and its visitors. They do not prohibit lawful activities or uses protected by applicable legislation.

Comments and User Submissions

Where comments or other interactive features are available, visitors are responsible for the information and opinions they choose to submit.

Comments must not contain unlawful material, threats, harassment, discriminatory abuse, defamatory allegations, spam, malicious links or content that infringes the rights of third parties.

We may moderate, reject or remove comments that violate these Terms, compromise the security of the Website or interfere with its legitimate operation.

By submitting a comment for publication, you authorise us to display that comment on the Website and to perform the technical operations reasonably necessary for its publication, moderation and administration. You retain ownership of any intellectual property rights you hold in your original contribution.

Submitting a private message through the contact form does not authorise its public publication. Personal data associated with submissions is processed in accordance with our Privacy & Cookie Policy.

Disclaimer and Limitation of Liability

We make reasonable efforts to provide clear, accurate and useful information. Nevertheless, the Website’s content may contain errors, omissions, outdated information or interpretations with which other market participants or analysts disagree.

Information is provided for general educational purposes and may be modified, corrected or removed without prior notice.

We do not guarantee the accuracy, completeness, continuous availability or suitability of the Website’s content for any particular purpose.

Trading with David is not responsible for financial losses arising solely from a visitor’s independent decision to trade or invest on the basis of general educational material published on the Website, except where liability arises under mandatory applicable law.

We cannot guarantee that the Website will always be available without interruptions, technical errors, maintenance periods or security incidents. We may temporarily restrict access when reasonably necessary for maintenance, security or technical reasons.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence or any other liability that cannot lawfully be excluded or limited under applicable law.

Nothing in these Terms affects any mandatory rights or protections that visitors may have under applicable consumer or other legislation.

Access and Restrictions

The Website is generally accessible without registration or a personal account. We reserve the right to take reasonable measures to protect its content, infrastructure and visitors from unlawful or abusive activities.

Where technically appropriate and legally permitted, these measures may include restricting access associated with malicious activity, automated attacks, excessive requests, spam or other conduct that threatens the Website’s security or operation.

We may modify, suspend or discontinue particular features or sections of the Website. Such changes do not affect rights that cannot lawfully be restricted.

Children

The Website provides educational information about trading and financial markets and is intended for a general audience. It is not specifically designed for children.

Under Italian law, minors aged 14 or over may independently consent to the processing of personal data in connection with information society services offered directly to children, where the applicable legal conditions are met. For younger children, the relevant requirements concerning parental responsibility must be respected when such consent is required.

This provision does not mean that the Website provides financial services to minors or that reaching the age of 14 establishes eligibility to trade financial instruments.

Financial products and trading services offered by independent third parties may be subject to separate age restrictions, legal requirements and contractual conditions.

Governing Law and Disputes

These Terms are governed by Italian law, subject to any mandatory provisions of applicable law that protect visitors residing in other jurisdictions.

If a disagreement arises concerning the use of the Website, we encourage visitors to contact us so that the matter can be examined and, where possible, resolved amicably.

Any legal dispute shall be submitted to the courts having jurisdiction under the applicable rules of law. Nothing in these Terms establishes an exclusive court of jurisdiction contrary to mandatory consumer protection provisions or other applicable jurisdictional rules.

Miscellaneous

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be ineffective to the extent required by applicable law without necessarily affecting the validity of the remaining provisions.

A failure to enforce a particular provision on one occasion does not automatically constitute a waiver of the right to enforce it subsequently.

References to third-party websites, services, companies or publications are provided for informational, educational or promotional purposes as applicable. Unless expressly stated otherwise, they do not establish a partnership, agency, employment or other legal relationship between the Website operator and those third parties.

We may update the Website and these Terms to reflect changes in its content, functionality, external services or legal requirements.

Complaints

If you have a complaint or concern relating to the Website, its content or these Terms, please contact us at info@tradingwithdavid.com.

Concerns specifically relating to the processing of personal data and the exercise of data protection rights are addressed in our Privacy & Cookie Policy.
